DONALDSONVILLE – An Ascension Parish convenience store is suing a fuel provider for not filling the store's tanks to the amount they claimed to have delivered.
D&J Grocery filed suit against Russell Daniel Oil Company and its owner Russell Daniel on Jan. 18 in the 23rd Judicial District.
D&J alleges Daniel had a contract with the store to regularly refuel its pumps, but that Daniel defrauded by delivering less fuel to the store's underground tanks than for which they were charging.
D&J is seeking damages for the amount of money they paid for fuel that was not delivered, in addition to attorney's fees.
D&J is being represented by Barbara L. Irwin of Gonzales-based Pujol and Pryor.
The case has been assigned to Division B Judge Thomas Kliebert, Jr.
