NEW ORLEANS – A New Orleans property owner is suing the city for attempting to sell the property to recover assessed fines.
Miccol Enterprises filed suit on Jan. 3 in the Orleans Parish Civil District Court against the City of New Orleans.
The plaintiff alleges the city declared its property at 2200 Ursulines Ave. blighted and a public nuisance and fined it for violating city ordinances related to keeping unoccupied property.
Miccol Enterprises claims it paid an initial fine of $575 for the property's bad condition and then took steps to address the city's concerns including a thorough cleaning of the premises and soliciting an estimate for the requested repairs. The plaintiff asserts the city still levied a fine of $9,000 and placed a lien on the property and prepared it for public sale after all requested repairs were not made.
The plaintiff is seeking to stop a public sale on the property that would interfere with the plaintiff's possession and enjoyment of the property in addition to a reasonable award for the premises, legal fees and expert fees.
