Homeowner insurance provider sued for not paying on theft claim

GRETNA – The trust of a Jefferson Parish woman is suing its homeowner's insurance policy provider for not paying out a claim.

The Gina M. Carraci trust filed suit on Feb. 7 in 24th Judicial District Court against Bankers Specialty Insurance Company.

The trust claims its insurer should have paid for damage and theft allegedly occurring during a break in at its property. The plaintiff claims it should be covered under the insurance policy and should be reimbursed after paying premiums for years without making a claim.

The defendant is accused of breaching its contract with the plaintiff.

Damages are sought in the amount replacement repair costs at the property plus attorney's fees.

The plaintiff is being represented by Michael H. Rasch of Metairie-based Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum and Hayes.

The case has been assigned to Division N Judge Hans Liljeberg.
