Doctor files personal injury suit against shopping center over trip and fall incident

NEW ORLEANS – A Jefferson Parish doctor is suing a local shopping center for injuries he claims he received in a fall on the premises.

Dr. Elliot Finkelstein filed suit on Feb. 27 in the 24th Judicial District Court against Weber Realty Group and its insurer.

Finkelstein claims he was walking a female companion to her car after dining at Acropolis in the shopping center when he tripped over an upturned piece of concrete in the parking lot and fell. He alleges he received multiple injuries to his mouth and fractures of multiple teeth due to the fall.

Finkelstein asserts the injuries he received were due to negligence by Weber Realty Group.

The defendant is accused of improperly maintaining the premises, not providing safe entrance or exit on the property, allowing dangerous conditions to exists on the premises, failing to warn of hazards, not providing adequate lighting in the parking area, failing to remove hazards and failing to re-pave the parking lot.

An unspecified amount in damages is sought for medical and drug expenses, pain and suffering, mental anguish, fear of eating certain foods, loss of enjoyment of life, severe anxiety, permanent partial disability and potential facial disfigurement.

Finkelstein is being represented by Metairie-based attorney Harris M. Dulitz.

The case has been assigned to Division I Judge Nancy A. Miller.
