Statewide fingerprint system at heart of fraud case

NEW ORLEANS – A Colorado corporation is suing a Delaware corporation for fraud for allegedly not providing working equipment needed to fulfill a contract.

Thinkstream, Inc. filed suit on March 5 against Morphotrak, Inc. in the Orleans Parish Civil District Court. The plaintiff claims it won a contract through the Louisiana Sheriff's Association to provide a statewide system for the digital entering and storage of fingerprint data. The defendants were allegedly contracted by the plaintiffs to provide an interface system for use in the program in addition to biometric scanner work stations for 64 parishes. The plaintiff alleges the defendant assured them it had a mature and tested system, but then allegedly failed to deliver functional and working hardware and software as per the agreement.

The defendant is accused of fraud for falsely representing its track record and capabilities of its products in order to entice the plaintiff into an agreement.

An unspecified amount in damages is sought for expected profits from the plaintiff's contract with the Lousiana Sheriff's Association and denigration of reputation.

Thinkstream is being represented by New Orleans-based attorney Vincent J. Booth.

The case has been assigned to Division G Judge Robin M. Giarrusso.
