NEW ORLEANS - After suffering injuries during an airboat tour of New Orleans, an Alabama couple has filed a lawsuit against the tour company claiming that they were driving the airboats too fast.
Joseph C. Hunt and Rachel Cunnigham Hunt filed suit against Airboat Adventures, Travelers Property Casualty Co. of America on May 10 in federal of New Orleans.
The alleged incident occurred on March 17 as Joseph and Rachel Hunt were visiting the City of New Orleans and were engaging in an airboat tour.
Near the conclusion of the tour, another airboat collided with the airboat in which the plaintiffs were passengers. The plaintiffs were thrown about the airboat causing Joseph to fracture ribs and Rachel to sustain multiple fractures to her pelvis.
The defendant is accused of negligence and breaching the standard of care for failing to maintain proper control of one or more of airboats, operating one or more of the airboats at an excessive rate of speed for the conditions, failing to yield appropriate right-of-way, for failing to provide appropriate warnings of their presence, and failing to appropriate operate and control the airboats.
The couple is seeking damages for physical and emotional pain and suffering, disability, loss of earnings, wages, impaired earning capacity, medical expenses, loss of society and consortium, loss of value of physical property, personal property, impaired enjoyment of various life's activities, interest, and court costs.
The plaintiffs are represented by Michael R. Allweiss and James T. Busenlener of Lowe, Stein, Hoffman, Allweiss & Hauver in New Orleans.
U.S. District Judge Lance M. Africk is assigned to the case.
