NEW ORLEANS - After slipping and falling while attempting to move merchandise, a Lowe's customer is suing the store for negligently allowing a foreign substance in the loading area.
Amy R. Hebert filed suit against Lowe's Home Centers Inc. and ABC Insurance Co. on Feb. 22, 2012 in Terrebonne Parish District Court. The defendant removed the case to federal court in New Orleans on July 10.
The accident occurred on Feb. 21, 2011 as Hebert was attempting to transfer merchandise from a dolly at the Lowe's Home Centers in Houma. Hebert slipped on a foreign substance, fell and was injured. She states she injured her left hip, knee, shoulder and low back.
The defendant is accused of negligence for failing to protect customers from the foreign substance.
The plaintiff is seeking damages for physical pain and suffering, medical expenses, mental anguish and distress, wage loss, disability, interest, and court costs.
Hebert is represented by William S. Bordelon of Bordelon & Shea in Houma.
U.S. District Judge Martin L. C. Feldman is assigned to the case.
