Huntington Ingalls name defendant in asbestos wrongful death case

Joseph E. "Jed" Cain

NEW ORLEANS – The wife and daughter of a deceased Louisiana man are suing a number of defendants for his alleged death from mesothelioma.

Annette LaPorte and Monique Ripp filed suit against Huntington Ingalls, et al in the Orleans Parish Civil District Court on July 3.

The plaintiffs claim their husband and father Joseph LaPorte, Jr. was exposed to asbestos fibers through his work at shipbuilder Avondale Main Yard in Avondale. In 1991 LaPorte was allegedly diagnosed with asbestosis. In addition, the plaintiffs claim they received second hand exposure to asbestos via their LaPorte bringing home asbestos fibers on his clothes.

The defendant is accused of failing to reveal the inherent dangers of asbestos, failing to provide necessary showers for its employees to protect the general public from asbestos exposure and failing to warn employees of risks associated with asbestos exposure.

An unspecified amount in damages is sought for medical expenses, burial expenses, loss of society, mental anguish and LaPorte's pain and suffering.

The plaintiffs are represented by Joseph E. "Jed" Cain of New Orleans-based Herman, Herman & Katz.

The case has been assigned to Division N Judge Ethel S. Julien.

Case no. 2012-06493.
