Winn-Dixie sued in slip and fall

NEW ORLEANS – A New Orleans woman has filed suit claiming injury on the premises of a grocery store.

Stephanie Bernard filed suit against Win-Dixie Louisiana, LLC in the Orleans Parish Civil District Court on July 6. Bernard claims she was a customer at the Winn-Dixie located at 9701 Chef Menteur Blvd. in New Orleans in July 2011 when she slipped and fell in a puddle at the store. The plaintiff alleges she sustained injuries to various parts of her body in the fall that necessitated medical evaluation and intervention.

The defendant is accused of failing to keep the store safe, failing to keep the store floor free of hazards, failing to close off a portion of the store that creates a danger for customers, failing to warn the petitioner of danger and failing to properly maintain the premises.

An unspecified amount in damages is sought for medical expenses, pain, suffering, mental anguish and loss of enjoyment of life.

Bernard is represented by New Orleans-based attorney Robert T. Hughes.

The case has been assigned to Division C Judge Sidney H. Cates.

Case no. 2012-06608.
