GRETNA – A Jefferson Parish woman is suing an elevator company for injuries she claims to have received when her home elevator allegedly failed and crashed to the bottom floor of her home.
Shirlene Vanderwall filed suit against All American Cargo Elevator, LLC in the 24th Judicial District Court on July 12. Vanderwall claims she contracted with All American Cargo Elevator for $3,600 to install and maintain a cargo elevator at her home located at 3012 48th Street in Metairie.
The plaintiff alleges that when she was moving a bag of kitty litter from the stopped cargo elevator on the third floor of her home the elevator failed and plummeted three stories to the bottom of the elevator shaft. Vanderwall asserts that she received serious and disabling injuries in the incident including to her lower body and spine.
The defendant is accused of negligently designing and manufacturing the elevator, improperly installing the elevator, failing to adequately inspect the cargo elevator and failing to provide adequate warnings of an unreasonably dangerous condition.
An unspecified amount in damages is sought for medical expenses, mental anguish, physical suffering, loss of enjoyment of life, loss of income, impaired earning ability, return of purchase price of elevator and reasonable attorney's fees.
Vanderwall is represented by Terry B. Loup of New Orleans-based Morris Bart.
The case has been assigned to Division N Judge Hans J. Liljeberg.
