Tenant sues landlord after tripping on stairs in rental location

GRETNA – A Texas woman has sued a Jefferson Parish landlord for injuries she claims to have received on her leased property.

Earline C. Carter filed suit against Arc Pro, Ohio Management, LLC, Lakeside I Limited Partnership and their insurers in the 24th Judicial District on July 18. Carter claims she was a resident of Sagewood Apartments on Edenborn Avenue in Metairie when she tripped and fell while walking up the stairs. The plaintiff claims the reason for her fall was an unreasonable height difference between the top stair and the stairwell landing. Carter asserts she received severe injuries in the fall.

The defendant is accused of not properly maintaining the stairwell, failing to keep stairwell in safe condition, not warning of a hazard, not repairing a hazard, failing to supervise the construction of the defective stairwell and having a common area stairwell in violation of local laws and building codes.

An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, physical disability, loss of enjoyment of life, emotional distress and lost wages.

Carter is represented by New Orleans-based attorney Kirk P. Dorsey.

The case has been assigned to Division B Judge Cornelius E. Regan.
