NEW ORLEANS - A Jefferson Parish woman is suing for injuries she received when she was hit by insulation that came off of a Home Depot forklift.
Theresa Bourg filed suit against Home Depot U.S.A. Inc. and Home Depot Inc. on March 27 in Jefferson Parish District Court.
The alleged incident occurred on May 26, 2011 when Bourg was shopping at the Home Depot store located in Marrero. She states she was injured when she was struck by insulation that flew off of a forklift truck.
The defendant is accused of negligence for failing to secure objects to the forklift, allowing them to fly off during high wind and striking Bourg, failing to secure insulation to the forklift when it should have known it would fly off during high wind, and for creating an unreasonable risk of harm.
The plaintiff is seeking damages for pain and suffering, mental anguish, medical expenses, scarring and disfigurement, permanent disability, lost wages, loss of earning capacity, loss of enjoyment of life, interest, and court costs.

U.S. District Judge Susie Morgan is assigned to the case.
