Wrongful death case claims worker was crushed by wall he was pressure washing

NEW ORLEANS – A New Orleans woman is suing a number of commercial entities for the death of her ex-husband.

Katrina Horton, on behalf of her daughter, filed suit against Black Rock Aggregates, LLC, Baker Transportation & Logistics, LLC, Baker Ready Mix, LLC and Rayabco Holdings, LLC in the Orleans Parish Central District Court on July 23.

Horton claims her ex-husband Dan Gordon was pressure washing a wall at 2838 Elysian Fields Ave. in New Orleans when the wall collapsed on top of him causing fatal injuries. The plaintiff alleges the wall was jointly owned by the defendants and was known to be on the verge of collapse.

The defendant is accused of failing to maintain proper control of their property, failing to exercise reasonable care, failing to warn others of danger and failing to act as prudent people would.

An unspecified amount in damages is sought for mental anguish, emotional distress, medical expenses, loss of community and support, loss of estate, loss of love and affection, loss of wages, loss of earning capacity, hedonic damages, pre-death pain and suffering, pre-death mental anguish, fear of death and funeral expense.

Horton is represented by John H. Denenea, Jr. of New orleans-based Shearman-Denenea, LLC.

The case has been assigned to Division N Judge Ethel S. Julien.
