Walgreens sued for allegedly dispensing wrong dosage

NEW ORLEANS – A New Orleans woman is suing a local pharmacy alleging she received an incorrect dosage on a prescription.

Elaine Williams Thompson filed suit against Walgreen Louisiana Co., Inc. in the Orleans Parish Central District Court on July 23.

Thompson claims she had a prescription filled for phenobarbitol at the Walgreen's located at 4200 Chef Mentor Hwy. in New Orleans on behalf of a dependent who has down's syndrome, but rather than receiving a 15 milligram dosage as a doctor prescribed they received a 60 milligram dosage instead.

The plaintiff alleges the mistake was uncovered three to four days later after numerous dosages had already been given. Thompson asserts that while her dependent was taking the medicine she was unable to maintain control of her body, maintain its stability as well as exhibiting other ill health effects.

The defendant is accused of failing to fill the proper prescription, failing to maintain a constant observation and quality control over the prescription, failing to maintain and adequate staff, failing to implement and promulgate policies and procedures ensuring quality control, failing to inform of the nature and risks associated with taking a mis-filled prescription and providing the wrong medication.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering and medical expenses.

Thompson is represented by New Orleans-based attorney Lillie E. Joyce.

The case has been assigned to Division F Judge Christopher J. Bruno.
