NEW ORLEANS – A national insurance agency has filed a lawsuit against a toilet product supplier for property damage.
State Farm Fire and Casualty Insurance filed suit against Watts Water Technologies, Inc. and its insurer in the Orleans Parish Civil District Court on July 26.
State Farm claims one of its home insurance policy holder's had a leak in a New Orleans home on Aug. 7, 2011 that caused significant water damage within the home. The plaintiff alleges the leak was caused by a faulty toilet pipe supplied by Watts Water Technologies and thus it should be liable for the damages.
The defendant is accused of dangerous supply line construction and composition, unreasonably dangerous design, supply line and parts that did not include warning and a supply line that allegedly did not conform to express warranties made by the defendant.
Damages in an amount less than $50,000 are sought by the plaintiff.
State Farm is represented by Metairie-based attorney James E. Brouillette.
The case has been assigned to Division I Judge Piper D. Griffin.
