GRETNA – A New Orleans family is suing a Kenner-based contractor over allegedly defective drywall.
Mark G. Pollock and Keri G. Pollock individually and on behalf of their children filed suit against Grand Orleans Properties, LLC, their building materials suppliers and their insurers in the 24th Judicial District Court on Aug. 2.
The Pollocks claim they bought a home from Grand Orleans Properties that was rebuilt after Hurricane Katrina damaged it. The plaintiffs claim that shortly after moving in parts of the home including the electrical and HVAC systems became defective due to toxic "Chinese drywall" that was allegedly installed in he home. The Pollocks assert that when the defective drywall combined with heat, humidity and moisture it let off gas causing corrosion to metal fixtures in the home.
The defendant is accused of negligence by not knowing of the defective condition of the drywall, unjustly enriching themselves based on the omission that the material was defective, not disclosing the potentially damaging side effects of the drywall, using the drywall without adequately inspecting it, failing to recall the defective product at the earliest date possible and representing the material was fit for the home when it was not.
An unspecified amount in damages is sought for economic damages, damages to real and personal property, physical pain and suffering, mental pain and suffering, emotional distress, fear, fright loss of enjoyment of life medical expenses and attorney's fees.
