Belladonna Spa sued by real estate broker on breach of contract claims

GRETNA – A New Orleans spa has been sued by a real estate broker for breach of contract after they allegedly terminated an agreement.

Capital Business Solutions, LLC filed suit against Belladonna, LLC in the 24th Judicial District Court on Aug. 21. Capital Business Solutions claims it entered into an agreement with Belladonna concerning the sale of its location at 2900 magazine St. in New Orleans. The plaintiff alleges that it was given a 12 month contract for the exclusive rights to market, advertise and sell the business in exchange for a brokerage fee of $85,800. Capital Business Solutions asserts that the contract stipulated it would receive the brokerage fee if the defendant terminated the listing contract before the end of the stipulated 12 month period. The plaintiff claims the defendant terminated the agreement before the end of the specified period.

The defendant is accused of breach of contract.

Damages in the amount of the $85,800 brokerage fee plus 24 percent interest is requested by the plaintiff.

The case has been assigned to Division C Judge Juneberry Darensburg.
