Stein Mart sued by woman who allegedly broke ankle after slipping on hanger

GRETNA – A Jefferson Parish woman is suing a local clothing store for injuries she claims to have received in a fall in a dressing room.

Dee Mader, with her husband Bruce, filed suit against Stein Mart, Inc. in the 24th Judicial District Court on Aug. 23. Mader claims she was trying on clothes in the dressing room at Stein Mart when she tripped and fell on a hanger that was on the dressing room floor. The plaintiff alleges that she received severe injuries to her right ankle including a fracture that had to be corrected through surgery implanting requiring the installation of plates and screws into her ankle.

The defendant is accused of maintaining the dressing room in a hazardous condition, failing to maintain the dressing room in proper condition, failing to exercise reasonable care in maintaining the dressing room, failing to discover the presence of the hanger in the dressing room before the incident.

An unspecified amount in damages is sought for permanent injuries, loss of consortium, loss of affection, loss of society and companionship, impairment of relations and attorney's fees.

The case has been assigned to Division D Judge Robert M. Murphy.
