Attorney sues Delta for flight delays and inconveniences

BATON ROUGE –A Baton Rouge man and woman are suing Delta over alleged multiple flight delays and inconveniences.

Kerri Keating and attorney G. Steven Duplechain filed suit against Delta Airlines, Inc. in the 19th Judicial Court on Aug. 10.

The plaintiffs filed suit for two separate occasions involving the defendant's alleged breach of contract.

On March 30, the plaintiffs were scheduled to travel from Baton Rouge to Washington D.C. Because of mechanical problems, their flight was delayed until the following day. They allegedly incurred hotel expenses in Washington D.C. because the hotel was prepaid and the hotel precluded cancellation of the reservation.

On June 9, the plaintiffs were scheduled to leave from Atlanta for Amsterdam at 5 p.m. At the time of departure, two toilets were discovered to have overflowed, making the designated plane unsuitable for use. The plaintiffs assert the defendant had a three-hour layover time to check for this problem, but didn't check until departure time, causing a five-hour delay.

On June 25, they arrived in New York from Amsterdam and were informed the flight to New Orleans had been canceled due to weather. The plaintiffs claim flights were still arriving and departing from the John F. Kennedy Airport, and Delta representatives were pressed for an explanation.

The representatives allegedly stated the basis of the weather claim arose from hurricanes and tornadoes in New Orleans. The plaintiffs assert no hurricanes or tornadoes were reported nor existed in New Orleans on June 25.

The plaintiffs allegedly had to pay for meals, housing accommodations and cab fares that Delta did not provide.

Plaintiffs seek recovery of compensation for their inconvenience of having to go to the airport at 4 a.m. on March 31, inconvenience and distress in losing vacation time and for the cost of the hotel room expense, which could not be used.

They are also seeking $1,000 for a day of missed work, resulting from the delayed flight from New York to New Orleans and for the hotel expense in New York.
