NEW ORLEANS - A New Orleans woman is suing a local retailer alleging her son was injured on its premises.
Velbert Stampley, on behalf of her minor son Michael Stampley, filed a lawsuit against Wal-Mart Stores, Inc. and John Doe in the Orleans Parish Central District Court on Aug. 7.
Stampley claims that while standing in the checkout line a large metal sign fell off the railing above the unidentified defendant, John Doe's, head and hit her young son in the forehead causing him to suffer injuries.
The defendants are accused of failing to maintain safety for the customers traversing within the checkout lanes, lack of appropriate inspection, creating unsafe conditions for patrons and failing to warn of a hazardous condition via warning signs.
An unspecified amount is sought for all damages including, but not exclusively, pain and suffering, emotional distress and all medical cost.
The plaintiff is represented by attorney Andrew Geiger of New Orleans.
The case has been assigned to Division F Judge Christopher J. Bruno.
