NEW ORLEANS – A New Orleans woman is suing a local grocery store for injuries she claims to have received on its premises.
Tammy L. Craft filed suit against Winn-Dixie Stores in the Orleans Parish Civil District Court on Sept. 18. Craft claims that when she was shopping at the Winn-Dixie located on Chef Mentor Highway in New Orleans on Sept. 28, 2011 she stepped in a clear liquid on the floor and fell. The plaintiff alleges she suffered severe injuries to her left leg, knee, ankle and back.
Craft claims that despite having a video camera on the site and being put on notice to preserve the surveillance video of the incident Winn-Dixie failed to do so.
The defendant is accused of allowing a clear liquid to be on the floor, failing to warn customers of the liquid on the floor and failing to maintain proper clean up and other inspection procedures.
An unspecified amount in damages is sought for pain and suffering, emotional distress, mental anguish, medical expenses, lost wages, loss of earning capacity, embarrassment, humiliation and disability.
Craft is represented by attorney Mark W. Smith of New Orleans.
The case has been assigned to Division N Judge Ethel S. Julien.
