Behavioral Health facility sued by caterer for breach of contract

BATON ROUGE – A catering company has filed suit against a Baton Rouge children's behavioral health facility after they allegedly broke a contract.

Cooking By Design, LLC filed suit against Pathways Community Behavioral Health Facility in the 19th Judicial Court on Oct. 9. On Sept. 27, 2011 the plaintiff and defendant allegedly entered into a written contract in which Cooking By Design agreed to provide catering services to the defendant. The plaintiff asserts the beginning paragraph on Page 1 of the contract states that if either party wants to terminate the contract, the party has to provide written notice 30 days prior to the termination.

On April 27, 2011, the plaintiff's vice president of operations, Alissa Karnes, states she was verbally contacted by the defendant and was informed that the company had removed the last of the kids out of the facility and subsequently the plaintiff's services were no longer needed.

The plaintiff asserts that the defendant's breach of contract has caused tremendous financial damages for Cooking by Design.

The defendant is accused of breaching a contract and not providing compensation for its breach.

An unspecified amount in damages is sought for punitive damages, legal interest, court costs and the cost of all experts and expenses in connection with the prosecution of these claims.

The plaintiff is represented by Baton Rouge-based attorney Jim Holt.

The case has been assigned to Division D Judge Janice Clark.
