Company sued for $100K over alleged sexual harrassment

NEW ORLEANS - A female worker has filed a gender discrimination lawsuit against her employer claiming the company permitted a co-worker to sexually harass her by not taking corrective action to prevent his harassing behavior.

Claiming violations of her civil rights, Destiny N. Scott filed suit against Brothers Expressway Inc. on Oct. 15 in federal court in New Orleans.

Scott claims that the defendant permitted a co-employee to sexually harass her, even after she complained of the co-worker’s harassing behavior.

According to the lawsuit, the co-worker would allegedly try to kiss Scott, would slap her derriere, attempt to grab her breast, and attempt to stick his hand in her pants.

Brothers Expressway is accused of employing supervisory discretion in a discriminatory manner against Scott because of her gender by failing to supervise or otherwise take appropriate correction actions to prevent the co-worker’s actions, and by failing to take corrective action for mistreatment of Scott when the treatment occurred because she was female.

The plaintiff is asking for an award of more than $100,000 in compensatory and punitive damages, plus court costs and attorney’s fees.

Scott is represented by New Orleans attorney Robert L. Marrero.

U.S. District Judge Sarah S. Vance is assigned to the case.
