Auto repair company sued for allegedly selling woman's car without consent

BATON ROUGE – A Baton Rouge woman is suing an automobile company after it failed to compensate her for allegedly selling her car without her knowledge.

Terry Hayes filed suit against MRI, LLC, doing business as Netterville's Auto in the 19th Judicial Court on Oct. 17. The plaintiff claims her car was towed on March 8, 2011 to the Netterville's Auto, located at 3401 Baker Blvd. in Baker for the sole purpose of having repairs made.

She claims she went to the defendant to check on the status of her car after not hearing from Netterville's, and found out her car was sold without her authorization. The car was allegedly destroyed without her authorization and without satisfying normal business standards pursuant to Louisiana Revised Statutes on Dec. 6, 2011.

Netterville's Auto offered to settle the plaintiff's property damage claims for $1,800 on July 9, 2012, the suit claims. The settlement was finalized on July 16, 2012, and the plaintiff claims more than 30 days have passed since the settlement was reached.

The defendant is accused of failing to pay the plaintiff the settlement amounts within 30 days after the settlement agreement.

An unspecified amount in damages is sought for the judicial demand to be paid in full and all costs of the proceedings.

The plaintiff is represented by Peter T. Dudley of Pierce and Shows.

The case has been assigned to Division E Judge William A. Morvant.
