Wheelchair bound man sues hotel for injuries allegedly received in fall off sidewalk

GRETNA – A wheelchair bound man is suing a national hotel chain for injuries he allegedly received in a sidewalk fall.

Corey Baker filed suit against Hotel 360, LLC in the 24th Judicial District Court on Oct. 1. Baker claims that he was visiting the Holiday Inn West bank on Oct. 2, 2011 when as he was proceeding in his wheelchair along the sidewalk one of the wheels got caught in a crack in the sidewalk and he tipped over and fell out of his chair. The plaintiff alleges that he was injured in the fall and required medical treatment for several months.

The defendant is accused of failing o maintain its premises, improper design or construction of the premises and placing handicapped parking in an area that required travel over defective surfaces.

An unspecified amount in damages is sought for medical expenses, pain and suffering, loss of use and permanent disability.

Baker is represented by New Orleans-based attorney Kim O'Dowd.

The case has been assigned to Division H Judge Glenn B. Ansardi.
