Hotel sued by woman whose infant son was injured when diaper changing table collapsed

GRETNA – A Jefferson Parish woman is suing a hotel for injuries her son allegedly received on its premises.

Emily Fulgham-Clay, individually and on behalf of her minor child, filed suit against Days Inn of Kenner and its insurer in the 24th Judicial District Court on Oct. 2.

Fulgham-Clay claims she was visiting the Days Inn located at 3400 South I-10 Service Road West in Metairie for a church event being held in one of the conference rooms. The plaintiff alleges that when she took her infant son to the hotel restroom she laid him on a diaper changing table and it collapsed beneath him causing him to fall to the floor and the table to fall on top of him. Fulgham-Clay asserts that due to the fall her son had head trauma that resulted in severe closed head injuries.

The defendant is accused of failing to properly secure and anchor equipment, allowing improperly installed equipment, creating a dangerous condition, failing to warn of a danger, failing to inspect equipment and failing to repair equipment.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish and emotional distress, loss of consortium, physical impairment, loss of enjoyment of life, loss of earning capacity and court costs.

Fulgham-Clay is represented by New Orleans-based attorney Marie A. Bookman.

The case has been assigned to Division L Judge Donald A. Rowan, Jr.
