Woman sues relative after allegedly falling down stairs

GRETNA – A Jefferson Parish woman is suing a relative and her home insurer for injuries she allegedly received in a fall down the relative's stairs.

Ethel Samples filed suit against Scarlet Samples and ASI Lloyds in the 24th Judicial District Court on Oct. 9. Ethel claims she was visiting Scarlet's home and was asked to climb a set of stairs to talk to someone on the second floor of the home. The plaintiff claims she knew the stairs had been originally covered with carpeting that was removed following water damage and that since she was afraid the stairs may be compromised she removed her shoes before climbing them. Ethel asserts that as she was descending the stairs they gave way and she fell and was injured.

The defendant is accused of failing to properly maintain the foundation of the stairs, failing to timely replace the damaged carpet padding, failing to replace the damaged carpeting that formerly covered the stairs, failing to apply adhesive strips to bare wood stairs to prevent guests from slipping and failing to maintain a safe environment.

An unspecified amount in damages is sought for medical bill and expenses, physical pain and suffering, mental anguish and emotional distress and loss of consortium and enjoyment of life.

The case has been assigned to Division F Judge Patrick J. Mccabe.
