EBR Constable's office sued over automobile accident

Reginald R. Brown, Sr., constable of the city of Baton Rouge.

BATON ROUGE – A Baton Rouge man and woman are suing the constable and constable's office after an alleged car accident.

Morris J. Bernard and Lora B. Wyatt filed suit against the city of Baton Rouge, Reginald R. Brown, Sr., Constable of the city of Baton Rouge, and Constable Leo I. LaMotte in the 19th Judicial Court on Nov. 7.

The plaintiffs claim LaMotte collided with him on Prescott Road on Nov. 15, 2011.

Bernard was driving a 1990 Oldsmobile 88, with Wyatt as a passenger, the suit claimsd.

He asserts LaMotte was in a 2009 Chevrolet Impala, owned by the city of Baton Rouge's Constable's office. Bernard states the defendant was making a left turn when he collided with Bernard's vehicle.

The defendant is accused of failing to stop and yield right of way, careless operation of a vehicle, failing to maintain proper outlook to avoid the collision and failing to apply the brakes before colliding with the plaintiff's vehicle.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, loss of enjoyment of life, disfigurement and disability, medical expenses, lost wages and property damage.

The plaintiffs are represented by Stephanie Legros-Willis of Dudley DeBosier Injury Lawyers.

The case has been assigned to Division M Judge Kay Bates.
