Royal Street grocer sued by customer over trip

NEW ORLEANS – Unique Grocery, located on Royal Street, is being sued by a woman claiming she slipped and fell while on its premises.

Donna Waters filed a lawsuit against Gohumal and Sons, Inc., D/B/A Unique Grocery and/or Real Unique Grocery and Colony Insurance Company in the Orleans Parish Central District Court on Sept. 5. Waters claims that, suddenly and without warning, she slipped and fell on a substance on the grounds of the defendant's establishment causing her to sustain permanent injuries.

The defendant is accused of failing to properly clean up the floor of the establishment, failing to post warning signs, and failure to provide and maintain a safe passageway.

An unspecified amount is sought for all damages including medical expenses, pain and suffering, mental anguish, emotional distress, loss of function and enjoyment of life, loss wages, pharmaceutical and prosthetic bills.

The plaintiff is represented by New Orleans-based John J. Finckbeiner, Jr. of New Orleans.

This case has been assigned to Division N Judge Ethel S. Julien.
