Baton Rouge airport sued in slip and fall

BATON ROUGE – A Kansas City woman has filed suit against a Baton Rouge airport after she allegedly fell on its premises.

Lola Esther Scudiero filed suit against the Greater Baton Rouge Metropolitan Airport District in the 19th Judicial Court on Nov. 28.

The plaintiff claims she was returning home on Dec. 13, 2011 after visiting her family in Natchez, Miss.

Scudiero, 74, was traveling with her husband and daughter, Michelle Kolich. Kolich asserts she was walking ahead of her mother when she turned around and saw her mother falling face forward onto the floor.

Scudiero was approaching the part of the airport between the carpeted area and the marble floor of the hallway when she allegedly fell.

The fall allegedly caused injuries to her face, teeth, hand, arm, legs and back.

According to the lawsuit, the fall was caused by a floor defect, a raise portion of the black rubber divider located between the marble flooring and carpeted portion of the floor by the airline terminal counter area. Scudiero asserts the raised portion of the black rubber divider was not easily visible to the naked eye and was a hidden danger because of its location and coloring.

The defendant is accused of failing to maintain its premises free from unsafe conditions, failing to inspect the terminal area, having knowledge of a dangerous condition and failing to take action to avoid injury to visitors and failing to provide the public with a reasonably safe transition from the carpeted floor to the marble floor.

An unspecified amount in damages is sought for physical pain and anguish, mental pain and anguish, loss of enjoyment of life and wage losses.

The plaintiff is represented by Patrick W. Pendley, Nicholas R. Rockforte and Jessica Perez of Pendley, Baudin & Coffin, LLP in Plaquemine.

The case has been assigned to Division E Judge William A. Morvant
