GRETNA – A Jefferson Parish woman is suing a local grocery store for injuries she claims to have received in a fall on its premises.
Mary Boyd filed suit against Winn-Dixie Stores, Inc., Winn-Dixie Montgomery, LLC, Winn-Dixie Louisiana, Inc., Winn-Dixie Montgomery Leasing, LLC, Bi-Lo, LLC and their insurers in the 24th Judicial District Court on Nov. 8.
Boyd claims she was shopping at the Winn-Dixie located at 2112 Belle Chasse Hwy. in Gretna when she was pushing her cart and stepped in a wet substance on the floor. The plaintiff alleges that as she began to fall she reached for a display attempting to break her fall. Boyd asserts that she told employees and managers who took a report of the incident. The plaintiff alleges she received severe injuries to her neck and back that necessitated medical treatment.
The defendant is accused of allowing the substance to accumulate on the floor, leaving the spill unmarked, failing to keep the aisles in the store free from hazardous conditions, failing to discover and remove the hazard, failing to observe the hazardous condition, failing to act reasonably under the circumstances and failing to have and follow appropriate procedures and clean-up of hazardous conditions.
An unspecified amount in damages is sought for pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, future disability and loss of income.

The case has been assigned to Division J Judge Stephen J. Windhorst.
