Our Lady of Divine Providence School sued by woman who broke bones at Grandparent’s Day

GRETNA – A Jefferson Parish woman is suing a parochial school after she tripped on a rug and broke her leg and hip while attending a grandparent’s day event.

Wilma Franchina filed suit against Our Lady of Divine Providence School, Our Lady of Divine Providence Roman Catholic Church, the Roman Catholic Church of the Archdiocese of New Orleans, The Catholic Mutual Relief Society of America, unidentified parties and their insurers in the 24th Judicial District Court.

Franchina claims she was attending the event with her grandchildren at Our Lady of Divine Providence School. The plaintiff alleges that when she walked into one of the school buildings she tripped on a rug and fell to the floor. Franchina asserts she suffered severe and disabling injuries in the fall including a broken left hip and femur.

The defendant is accused of failing to maintain the rug, failing to remove the rug from the entrance, failing to provide a safe environment, failing to exercise reasonable care, failing to implement routine safety inspections, failing to warn of a hazard and failing to implement a post-accident procedure.

An unspecified amount in damages is sought for pain and suffering, mental pain, emotional pain, anxiety, humiliation, embarrassment, medical expenses, permanent scarring and loss of enjoyment of life.

Franchina is represented by attorney Donald M. Pierce of New Orleans.

The case has been assigned to Division E Judge John J. Molaison, Jr.

Case no. 721-127.
