NEW ORLEANS - A Tangipahoa Parish man has filed a lawsuit against his former employer claiming it failed to follow through with an agreement to pay him almost $8,000 in overtime wages.
David Germenis filed suit against Z Industries, Don Zemo Jr., Larry McNeely, Inspririon Management Group Inc., and M. Todd Barnes on Dec. 21 in federal court in New Orleans.
Germenis was hired by the defendant in 2008 and was last employed through February 2010. During his employment, he worked more than 40 hours per week, but was not paid time and one-half for overtime hours, according to the complaint.
Germenis claims the Department of Labor conducted an investigation and the defendants agreed to pay the plaintiff the sum of $7,800.
The defendants are accused of willfully violating the Fair Labor Standards Act by failing or refusing to pay Germenis at the rate of time and one-half for all overtime hours he worked.
The plaintiff is seeking an award of damages for unpaid overtime wages, liquidated damages, penalty wages, court costs, interest, and attorney’s fees.
Germenis is represented by Thomas J. Hogan Jr. of Hogan & Hogan in Hammond.
U.S. District Judge Eldon E. Fallon is assigned to the case.
