NEW ORLEANS - A Hispanic worker has filed a lawsuit against his former employer claiming that he was terminated due to racial and national origin discrimination.

Fidel D. Deleon filed suit against General Insulation Inc. of Louisiana on Jan. 3 in federal court in New Orleans.

Deleon, who is from the Dominic Republic, began working for General Insulation in Theodore, Ala. in October of 2010. A year later, Deleon was terminated along with other Dominican Republic workers for “lack of work.”

Deleon argues that despite his excellent performance records, General Insulation discriminated and created a hostile work environment against him because of his race, Hispanic and national origin by failing to employ, promote, pay and treat him equal to “Non-Hispanics” and encouraging an environment that promotes discrimination and harassment.

The plaintiff is seeking an award of damages for back pay, interest, front pay, pecuniary loss, job search expenses, medical expenses, non-pecuniary losses, emotional pain, suffering, inconvenience, loss of enjoyment of life, reduction in the standard of life, strain on his relationship with family, lowered self-esteem, humiliation, compensatory damages, attorney’s fees, court costs, and punitive damages.

Deleon is represented by Robert B. Evans III, Cesar R. Burgos, Gabriel O. Mondino, and Robert J. Daigre of Burgos & Evans in New Orleans. A jury trial is requested.

U.S. District Judge Susie Morgan is assigned to the case.
