Orleans Parish woman sues Wendy's after slipping and falling

NEW ORLEANS - An Orleans Parish woman has filed a lawsuit against a LaPlace fast-food restaurant claiming she slipped in a foreign substance and sustained serious injuries.

Adine Piediscalzo filed suit against Wendy’s International Inc., Jeannine Prine and ABC Insurance Co. on Dec. 13 in St. John the Baptist Parish District Court. The defendant removed the case to federal court in New Orleans on Jan. 7.

The accident occurred on Jan. 28, 2011 as Piediscalzo was a patron at the Wendy’s Restaurant in LaPlace.

The defendant is accused of negligence for failing to provide proper maintenance and keep their premises in a safe condition for their customers, failing to properly train or supervise their employees as to methods of maintenance, repair, and inspection to insure safe passage for their customers and prevent this type of accident from happening, failing to take necessary measures to protect the safety of its patrons, knew or should have known of the unsafe condition of the area in question, failing to remedy an unsafe or hazardous condition, and for failing to keep the area clean and in proper working condition.

Piediscalzo is seeking an award of damages for physical pain and suffering, mental pain and suffering, property damages, medical expenses, loss of past earnings, loss of future earning capacity, permanent disability of the body, loss of consortium, penalties, attorney’s fees, interest and court costs.

The plaintiff is represented by Roderick Alvendia, J. Bart Kelly III, and Jeanne K. Demarest of Law Office of Alvendia, Kelly & Demarest, LLC in New Orleans.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
