Woman sues pacemaker manufacturer for father's death

NEW ORLEANS – A New Orleans woman faults the manufacturer of a pacemaker for her father’s death.

Nicole Perry filed suit against the unknown pacemaker manufacturer in the Orleans Parish Civil District Court on Jan. 7.

The case concerns James Johnson, a New Orleans man who died on Jan. 6, 2012. Perry is Johnson’s heir and the administrator of his estate. After Johnson’s death, an autopsy was performed. The handwritten petition claims that the autopsy listed the pacemaker as one of the contributing factors in Johnson’s death.

The defendant is accused of contributing to Johnson’s death because the pacemaker failed to perform as expected to prevent his death.

An unspecified amount of damages is sought for wrongful death, survival action and attorneys’ fees.

The plaintiff is represented by Hollis Shepherd of New Orleans.

The case has been assigned to Division D Judge Lloyd J. Medley.
