BATON ROUGE – A Baton Rouge woman is suing her former attorneys for failing to timely file a lawsuit on her behalf.

Brenda W. Collins filed suit against a George E. Downing, Lon E. Roberson and their insurer the 19th Judicial District Court on Feb 6.

Collins claims in 2009 she was receiving treatment for a lower back injury that occurred during physical therapy when she retained Downing and Roberson as her attorneys for legal advice for a claim arising out of the injury. The plaintiff alleges that in 2011 her attorneys withdrew from the case and that she later learned they had failed to properly file a lawsuit in time.

The defendant is accused of failing to timely file suit against and serve all potential defendants and failing to act with diligence and care.

An unspecified amount in damages is sought for permanent loss of opportunity for the plaintiff to assert any claims for damages, attorney’s fees and cost of litigation.

Collins is representing herself in the case.

The case has been assigned to Division I Judge R. Michael Caldwell.
