Family of wheelchair-bound man who died crossing street sues

GRETNA –The family of a deceased Jefferson Parish man is suing the driver and owner of a vehicle that ran him over as he crossed the street in his wheelchair.

Linda Doster, Denice Thompson, Deborah Cortez and Gregory Doster as proper beneficiaries and on behalf of their deceased brother Richard Doster filed suit against Michel Remy, Fresenius Medical Care, Continental Casualty Company and CNA Financial Corporation in the 24th Judicial District Court on Jan. 23.

The plaintiffs claim Remy was driving a vehicle owned by Fresenius Medical Care that ran over their brother. The plaintiffs allege the injuries Doster received in the crash resulted in his death.

The defendant is accused of failing to keep a proper lookout, failing to maintain control, following too close to the plaintiff, failing to stop or slow down, inattentive driving and failing to control speed.

An unspecified amount in damages is sought for physical injuries, compensation for property damage, loss of use, rental reimbursement, attorney's fees and legal costs.

The plaintiffs are represented by attorney Brandon J. Venegas of Metairie.

The case has been assigned to Division C Judge June Berry Darensburg.
