Woman sues after allegedly hurting shoulder while trying to open bathroom door

GRETNA – A Kenner woman is suing a gas station claiming she injured her shoulder after she pulled on a bathroom door trying to open it.

Christina M. Johnston filed suit against Diaz II, Airport Shell, Diaz Realty Investments LLC, CNA Casualty Company and Columbia Casualty Company in the 24th Judicial District Court on Jan. 23.

Johnston claims she was a customer at the Airport Shell in Kenner when she was granted access to the establishment's bathroom. The plaintiff alleges that when she tried to open the bathroom door it would not budge and after being told to pull up on the door by a gas station employee she injured her shoulder. Johnston asserts she sustained severe injuries to her shoulder, head, bruises, abrasions and contusions.

The defendant is accused of failing to provide a safe retail environment, maintaining the premises in a state of ruin, failing to provide a safe retail environment free from vice and defect, maintaining the premises in an inherently dangerous condition, failing to warn of inherently dangerous condition and failing to instruct in the safe use of premises facilities.

An unspecified amount in damages is sought for loss of income, medical expenses and pain and suffering.

Johnston is represented by Arthel J. Scheuerman of New Orleans-based Scheuerman & Jones LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
