Contractor sues window installer for alleged defects

GRETNA – A Jefferson Parish contractor is suing a glass company over the allegedly defective installation of windows in a building it was contracted to build.

Gibbs Construction LLC filed suit against 3-D Enterprises, 3-D Glass Company, QBE Insurance Corporation and Companion Property & Casualty Group in the 24th Judicial District Court on Jan. 24.

Gibbs Construction claims it was contracted to construct a new building in Gulfport, Miss. known as the Gulfport Hewes Martin Building. The plaintiff alleges that it contracted 3-D Glass to provide and install entrances, exits and windows throughout the building.

Gibbs Construction asserts that after the defendant completed their work on the project it became apparent that there were significant problems with the installations including not being watertight. Gibbs Construction alleges that though it negotiated with 3-D Glass to repair and replace the windows the problems resulted with extra costs involved with protecting the interior of the building from the elements.

The defendant is accused of improper installation and poor workmanship.

An unspecified amount in damages is sought for additional cost, supervision and assistance replacing and repairing the windows and court costs.

Gibbs Construction is represented by Denise C. Puente on New Orleans-based Simon, Peragrine, Smith and Redfearn LLP.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
