Rouse’s sued by man who allegdly fell in puddle of water

GRETNA – A Jefferson Parish man is suing a local grocery store after he had to get corrective surgery following an alleged fall in a puddle of water in the store.

Edmond H. Ganucheau III filed suit against Rouse’s Enterprises LLC in the 24th Judicial District Court on Jan. 25. Ganucheau claims he was a customer at the Rouse’s located at West Esplanade and Chateau Boulevard in Kenner and was walking near the frozen foods section when he stepped in puddle of water and fell to the floor. The plaintiff alleges the puddle was caused by a malfunctioning freezer unit. Ganucheau asserts he injured his left knee, left ankle and lower back in the incident and needed surgery as a result.

The defendant is accused of failing to maintain refrigeration equipment in working order, failing to clean and service refrigeration equipment, failing to warn customers of hazard, failing to properly and timely inspect the premises for hazards, failing to take corrective measures and failing to maintain the aisles and passageways of the store.

An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, enjoyment of life, lost wages and loss of earning capacity.

Ganucheau is represented by Albert J. Nicaud of Metairie-based Nicaud & Sunseri LLC.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
