Foy Construction accused of selling home with defects

Breach of contract

NEW ORLEANS – The purchaser of a New Orleans home is suing the home builder over alleged defects.

Geromy Moore filed a lawsuit against Foy Construction LLC and Bruce Foy Sr. in the Orleans Parish Central District Court on Jan. 23.

Moore claims the defendants sold him a home that began showing defects in the cathedral ceilings gradually that were a result of work done by Foy prior to the sale.

The defendant is accused of knowing that the defects existed on the property, failing to properly make structural changes to the premises, failing to obtain proper permits and being in violation of City Ordinance and State Law.

The plaintiff is seeking damages reasonable in premises, the reduction of the purchase price of the home, retribution for aggravation, mental anguish and inconvenience.

Moore is represented Albert J. Nicaud of Nicaud & Sunseri LLC.

This case has been assigned to Division D Judge Lloyd J. Medley.

Case no. 2013-766.
