Woman sues Winn Dixie and floor cleaning service after falling on recently waxed floor

GRETNA – The local outlet of a grocery store chain and its floor cleaning contractor are being sued by a woman who claims she was injured in a fall on a recently waxed floor.

Jo Ann Miller filed suit against Southern Cleaning Services Inc. and Winn Dixie Stores Inc. in the 24th Judicial District Court on Feb. 4.

Miller claims she was shopping at the Winn Dixie located at 3645 Lapalco Blvd. in Harvey when Southern Cleaning Services was cleaning and waxing the store floor.

The defendant is accused of failing to maintain the premises in a reasonably safe condition, failing to inspect the premises before allowing customers to enter, failing to warn of the dangerous condition of the wet and slippery floor, failing to correct a dangerous situation and allowing conditions to exist that create an unreasonable risk of injury.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish and distress, disability, loss of enjoyment of life, loss of wage earning capacity and medical expenses.

Miller is represented by David E. Kavanaugh of New Orleans-based Kavanaugh & Rendeiro.

The case has been assigned to Division G Judge Robert A. Pitre Jr.
