NEW ORLEANS – A local cement company is suing a contractor for allegedly not paying for materials used in the construction of a school building in New Orleans.

Block Mix USA filed suit against Brice Building Company LLC in the Orleans Parish Civil District Court on Jan. 30.

Brice Building Company contracted with the Recovery School District to complete construction on Carter Woodson School in the Central City neighborhood of New Orleans. Block Mix provided materials for the project and claims to be owed $107,138.42 by Brice. The cement company states that the contractors have failed to pay even though they received payment from the school district.

The defendant is accused of breach of contract.

The full amount owed is sought in damages, along with interest, attorney’s fees, the cost of the proceedings and a penalty for the late payment.

Block Mix is represented by H. Minor Pipes III of New Orleans-based Barrasso, Usdin, Kupperman, Freeman & Sarver.

The case has been assigned to Division F Judge Christopher J. Bruno.

Case No. 2013-00981.
