NEW ORLEANS - A Louisiana man has filed a lawsuit against the manufacturers of the diabetes prescription drug Avandia claiming the drug caused him to suffer a stroke.
Jesse Hardy Jr. filed suit against Smithkline Beecham Corp., Glaxosmithkline, and Smithkline Beecham Corp. d/b/a Glaxosmithkline on April 9 in federal court in New Orleans.
The defendants are accused of negligence in the design, development, manufacture, distribution, labeling, advertising, marketing, promotion, and selling of the widely-used diabetes prescription drug Avandia.
The defendants are accused of failing to warn, breach of warranty, strict products liability, fraudulent misrepresentation, and violation of Pennsylvania Unfair Trade Practice and Consumer Protection Law.
Hardy claims he took the drug Avandia due to the defendants’ alleged omission of the increased risk of adverse cardiovascular events. Hardy claims he suffered a stroke and aggravation to a pre-existing heart condition.
The plaintiff is seeking an award of actual, treble, and punitive damages, interest, court costs, and attorney’s fees, and court costs.
Hardy is represented by New Orleans attorneys John D. Sileo and Kevin P. Riche. A jury trial is requested.
U.S. District Judge Jay C. Zainey is assigned to the case.
