NEW ORLEANS – An owner of a 2007 Mercedes-Benz GL450 is suing the Mercedes-Benz Corp. after the driver’s seat of his vehicle allegedly caught on fire.
Ernest Castle filed a lawsuit against Mercedes-Benz USA LLC in the Orleans Parish Central District Court on Feb. 8.
Castle claims that while operating his vehicle on I-10 near Morrison Road - suddenly and without warning - the heating element in the driver’s seat ignited and burned the driver’s seat causing damage to the driver’s seat and bodily injury.
The defendant is accused of producing a product which was unreasonably dangerous in its construction or composition, producing a product that was dangerous in design, not providing adequate warning of the defects and producing a product that failed to conform to an express warranty of the manufacturer about the product.
Castle is seeking compensation for medical expenses, pain and suffering, residual disability, property damage and loss of use.
The plaintiff is represented by Timothy L. Fields of New Orleans-based Law Offices of Tim L Fields.
This case has been assigned to Division G Judge Robin M. Giarrusso.
