Woman claims loss of use of arm after falling at work

NEW ORLEANS – Plaintiff Jessica Rosales is suing LA Pointe 2 LLC and its insurer in the Orleans Parish Civil District Court.

Rosales claims she started working at Pointe Bar on Tulane Avenue in May 2012. The alleged incident occurred on Oct. 21, 2012 when Rosales was walking toward the women’s restroom. She allegedly slipped on water and fell to the floor. The suit claims that the water came from a leaking bathroom toilet that was in a state of disrepair.

The defendant is accused of negligence for failing to maintain the safety of the premises despite actual or constructive knowledge of a dangerous condition.

An unspecified amount of damages is sought for physical pain and suffering, mental anguish and distress, medical expenses, loss of wages, permanent disability, permanent loss of use of a limb, disfigurement and loss of future earning capacity.

The plaintiff is represented by Romualdo Gonzalez and Gloria T. Lastra of Braden, Gonzalez & Associates.

The case has been assigned to Division J Judge Paula A. Brown.
