Wendy’s sued by woman claiming food poisoning

GRETNA – A Jefferson Parish woman is suing a local fast food restaurant claiming she became ill after eating a partially cooked chicken sandwich.

Lettita Davis II filed suit against Wendy’s of Jefferson LTD and Sedgwick Claims Management Services Inc. in the 24th Judicial District Court.

Davis claims she bought a chicken sandwich from the Wendy’s at 3705 Jefferson Highway and after eating a portion of it found that it was not fully cooked. The plaintiff claims she became ill and visited a local hospital where she was treated for her illness. Davis asserts she reported what happened to the store manager who gave her information to file a claim and later in the day she took a photo of the raw chicken sandwich.

The defendant is accused failing to properly prepare its products, failing to properly cook its products, failing to protect its customers by properly preparing and cooking its food items, negligence in selling a raw chicken sandwich to its customers, failing to see what should have been seen, failing to protect its customers by not selling an undercooked and raw chicken sandwich and failing to keep a wholesome food item.

An unspecified amount in damages is sought for pain and suffering, mental anguish and loss of life’s pleasures.

Davis is represented by attorney Lettita Parker-Davis of Gretna.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 724-255.
