Subcontractor who fell from second floor balcony sues

Summerfield+apartments

GRETNA – A St. Tammany Parish man claims he was injured in a workplace incident while working as a subcontractor at an apartment complex.

Raymond Terese Jr. filed suit against 1500 Lorene LLC, 2700 Whitney LLC, Century Insurance Company and Lexington Insurance Company in the 24th Judicial District Court on March. 8.

Terese claims he was working as a contractor doing renovations at the Summerfield Apartments in Harvey Apartment owned by 1500 Lorene LLC. The plaintiff alleges he had just finished installing a counter top in one of the 220 apartment units in the building and when he exited the apartment he slipped and fell off a balcony that did not have a guardrail attached to it. Terese asserts he was injured in the fall.

The defendant is accused of failing to properly maintain and supervise the construction site which the defendant had contracted to perform renovations, failing to properly use temporary guard railing or caution tape to prevent people from falling off the balcony, failing to warn the users that the balcony railings were missing and being in violation of OSHA regulations.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, loss of wages and loss of earning capacity.

Terese is represented by Curtis C. Kronlage of New Orleans-based Kronlage & Kronlage.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
