Couple who paid contractor $70K suing over incomplete work

Breach of contract

GRETNA – A Jefferson Parish couple is suing a local contractor for allegedly doing incomplete and unacceptable work on their home.

Clint and Debra Fultz filed suit against Brotherhood Way General Contractors LLC and Arthur J. Gallagher Risk Management Services Inc. in the 24th Judicial District Court on March. 13.

The Fultzes claim they signed a contract with Brotherhood Way General Contractors representative David Weathersby for a total of $88,560. The plaintiffs allege it was not until they had paid the defendant $70,000 that they found the defendant had not provided proper and adequate services. The Fultzes assert that much of the work stipulated under the contract was never completed and that they had to pay another contractor $50,000 to complete the job. The plaintiff claims Weatherby’s cousin also visited the worksite and pointed out the problems with the workmanship on the job and that he offered to complete the job for $45,000, which the plaintiffs declined.

The defendant is accused of breach of contract.

Damages of $50,000 are sought by the plaintiffs.

The plaintiffs are represented by attorney Thomas F. Schexnayder of New Orleans.

The case has been assigned to Division D Judge Walter J. Rothschild.
